Article 1 — Definitions
- Seller: FME Moto B.V., trading as FME Moto.
- Customer: the natural or legal person who buys a product or uses a service.
- Agreement: any agreement for the supply of products or services.
- Webshop: the online store at fmemoto.com.

Article 3 — Applicability
These terms apply to all offers, agreements and deliveries of the Seller. Deviations are valid only if agreed in writing.
Article 4 — Offers and prices
- All prices in the webshop are inclusive of VAT, excluding shipping costs unless stated otherwise.
- Motorcycle prices are road-ready prices unless otherwise stated; details are provided in the quote.
- Offers are non-binding and valid while stocks last.
- The Seller reserves the right to correct obvious price or typing errors, even after order confirmation.
Article 5 — Orders and conclusion
An agreement comes into effect once the Seller confirms the order by email. The Seller may refuse an order or attach additional conditions to it, for example in case of doubt about stock or payment.
Article 6 — Payment
- Online payment is processed via MultiSafepay (iDEAL, credit card, Bancontact, Apple Pay, bank transfer).
- For prepayment by bank transfer, the order is shipped only after the full amount has been received.
- Business customers can — subject to approval — buy on account with a 14-day payment term.
- Late payment incurs statutory (commercial) interest plus any collection costs.
Article 7 — Delivery and shipping
- Shipping is via DHL. Shipping costs depend on destination country and order value — see the shipping table during checkout.
- Delivery times are indicative: 2–5 business days within the Netherlands, 3–10 business days within the EU.
- Risk of damage or loss during shipping passes to the Customer at the moment of delivery.
- Pickup at our store is free; you receive a notification once the order is ready.
Article 8 — Right of withdrawal
For online purchases you, as a consumer, have the right to dissolve the agreement without giving reasons within 14 days of receipt.
- You can exercise the right of withdrawal via your account or by sending us an email.
- Products must be returned unused and in their original packaging.
- The cost of return shipping is at the Customer's expense, unless the product is defective or incorrectly delivered.
- We process the refund within 14 days of receiving the return, via the original payment method.
Exceptions: motorcycles, custom-fitted or specially ordered parts, and products that cannot be returned for hygiene reasons (e.g. helmets that have been tried on or worn) are excluded from the right of withdrawal.
Article 9 — Warranty
- New motorcycles are covered by BMW Motorrad's factory warranty (2 years standard, optionally extendable).
- Used motorcycles receive at least the statutory conformity warranty; additional terms are agreed at the time of sale.
- Parts and accessories carry the manufacturer's warranty, with a minimum of 6 months for consumers.
- Warranty claims can be submitted via your account, by email, or by phone.
Article 10 — Workshop and service
- Service jobs are performed to factory specifications with original BMW parts, unless agreed otherwise.
- Any additional work is presented to you for approval before it is carried out.
- Workshop appointments can be rescheduled free of charge up to 24 hours in advance.
- If you do not collect your motorcycle within 14 days of completion, storage fees may apply.
Article 11 — Liability
Our liability is limited to direct damage and to the amount paid out by our insurer in the relevant case. Indirect damage — including lost profit, loss of revenue or consequential damage — is excluded, except in cases of intent or gross negligence.
Article 12 — Privacy
Our privacy policy applies to all personal data we process in the context of an agreement.
Article 13 — Complaints
Have a complaint about our products or services? Send it within a reasonable time after discovery to info@fmemoto.com. We respond within 14 days with a substantive reply.
If we cannot resolve the matter together, you can submit your dispute to the Disputes Committee or via the European ODR platform at ec.europa.eu/consumers/odr.
Article 14 — Applicable law
Dutch law applies to these terms and to all agreements. The competent court is that of the Northern Netherlands judicial district, Groningen location, unless mandatory law provides otherwise.
Article 15 — Changes
We may update these terms from time to time. The version that applies is the one published at the time the agreement was concluded.
